Star Talent Defection/HR Issues Resulted in Legal Action
Client Situation
Our client, a fast-growing optical telecommunications start-up, hired
an outstanding sales person from a rival who promptly filed for an injunction
claiming that the information known to the salesperson was confidential
and proprietary.
Fuld Approach
Fuld & Company was hired to demonstrate exactly what types of information
could be obtained through legal and ethical means and was therefore public
vs. what would be confidential and proprietary. As part of this effort,
Fuld & Company attended a large optical networking technology conference
and spoke with representatives of the rival and its key customers who
were attending or presenting at the conference.
Benefits and Implications
The results of these discussions plus additional secondary and primary
research demonstrated that the vast majority of the information cited
in the request for the injunction was in fact public and allowed our client
to put its new hire to work quickly.
